6. Disclaimer of Warranties

BluFerge disclaims all warranties, including, but not limited to, warranties of merchantability, fitness for a particular purpose, and non-infringement. BluFerge does not warrant that the Platform will be uninterrupted, error-free, or free of viruses or other harmful components.
7. Limitation of Liability
BluFerge will not be liable for any damages arising from your use of the Platform, including, but not limited to, direct, indirect, incidental, consequential, special, or punitive damages. This includes, but is not limited to, damages for loss of profits, data loss, business interruption, or personal injury, even if BluFerge has been advised of the possibility of such damages.
8. Termination
BluFerge may terminate your access to the Platform for any reason, with or without notice, including but not limited to:
Violation of these Terms of Service
Suspicious activity on your account
Failure to pay any applicable fees (if a fee structure is implemented)
Extended periods of inactivity
9. Governing Law and Dispute Resolution
This Agreement shall be governed by and construed in accordance with the laws of the United Kingdom. You agree to submit to the exclusive jurisdiction of the courts located in the High Court of Justice, in England and Wales, for all disputes arising out of or relating to this Agreement.
10. Entire Agreement
This Agreement constitutes the entire agreement between you and BluFerge with respect to your use of the Platform.
11. Severability
If any provision of this Agreement is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall remain in full force and effect.
12. Updates to Terms of Service
We may update this Agreement from time to time. Your continued use of the Platform after any such update constitutes your acceptance of the revised Agreement. We will post any changes on the Platform and notify users through a prominent notification.
13. Intellectual Property
All content on the Platform, including but not limited to text, graphics, logos, images, software, and other materials, is the property of BluFerge or its licensors and is protected by copyright and other intellectual property laws. You may not use any content on the Platform for any commercial purpose without the express written consent of BluFerge.
14. Indemnification
You agree to indemnify, defend, and hold harmless BluFerge, its officers, directors, employees, agents, licensors, and suppliers from and against all claims, losses, expenses, damages, and costs, including reasonable attorneys' fees, arising out of or relating to your use of the Platform or your violation of this Agreement.
15. Electronic Communications
By using the Platform, you agree to receive electronic communications from BluFerge, such as emails, notifications, and push messages. You also agree that these electronic communications will satisfy any legal communication requirements that would otherwise require a written communication.
16. Assignment
This Agreement may not be assigned by you without the prior written consent of BluFerge. BluFerge may assign this Agreement without your consent.
17. No Waiver
No waiver of any provision of this Agreement by BluFerge shall be deemed a further or continuing waiver of such provision or any other provision.
18. Force Majeure
BluFerge shall not be liable for any delay or failure in performance due to causes beyond its reasonable control, such as acts of God, war, terrorism, strikes, or natural disasters.
19. Headings
The headings used in this Agreement are for convenience only and do not constitute a part of these Terms of Service.
